Grace Period Extended to 12 Months.
Japan Patent Office (JPO) announced that the revised patent and design laws passed the national diet i.e. Japan’s bicameral legislature, and the revised Article 36 in patent law and Article 4 in design law, grace period, will become effective as of June 9, 2018.
These revisions are related to the extension of the Grace Period from 6 months to 12 months, and will apply to the applications filed at the filing date of June 9, 2018 or later.
As the revised Article 36 of patent law shall apply to the utility model law mutatis mutandis, grace period in utility model law is extended from 6 months to 12 months, too.
