An applicant must file a request for examination within 3 years from the filing date. The filing date means not the priority but actual filing date. If the applicant passes the deadline without a justifiable reason, the application shall be regarded as withdrawal. The applicant should pay attention to this deadline since there is no such reinstatement system that the applicant pays a penalty of doubled examination fee.
The examination fee depends on the type of applications and the number of claims. The applicant needs to pay following fees to JPO in requesting for substantive examination.
• In PCT case, where the international search report has been established by an International Searching Authority other than the JPO,
examination fee will be ¥124,000 plus ¥3,600 per claim.
• In National application or direct application to JPO via Paris convention,
examination fee will be ¥138,000 plus ¥4,000 per claim.
Examination fee is expensive. A foreign residence, however, may apply for fee reduction in filing the international application on or after April 1st 2019.
For instance,
• Small & Medium Enterprises of Software service industry* is eligible for reduction to 1/2.
*The number of employees is up to 300, the amount of capital or total contribution is up to 300 million yen and it is not under the management of large enterprises. And
• Micro Sole Proprietorship** is eligible for reduction to 1/3.
**It is any entity with 20 employees or less (5 or less for commerce or service industry) and is not under the management of large enterprises.
Further, the applicant is not required to submit Certificates for reduction or exemption.
